Statutory Residence Test

HM Treasury have finally released their response to the consultation into implementing a statutory residence test from April 2013.
The document outlines a summary of the responses received and also highlights any refinements to the original proposals that have been made. There is some much welcome clarification on certain definitions within the proposed test, although invariably some question marks will remain.
It is a three-tier test, broken down into those who are conclusively non-resident, conclusively resident or if they do not apply, the connections an individual has with the UK and the number of days that they spend here are considered in the final test:
• Those who are conclusively non-resident will be
o anyone present in the UK for fewer than 46 days if they have been non-resident in all of the previous three years, or
o present for fewer than 16 days if they have been resident in one or more of the previous three years, or
o work full-time abroad and are present in the UK for fewer than 90 days with no more than 20 days* spent working in the UK
* The consultation document outlines that the Government are requesting views on whether this should be increased to 25 days.
• Those who are conclusively resident will be:
o Anyone present for more than 183 days in the tax year, or
o Only has one home and that home is in the UK, or
o Works full-time in the UK
• If Parts A & B do not apply, then the number of connecting factors with the UK and the amount of time spent in the UK determines the status.

Mark,

If a UK non resident who has frequently visited the UK, where they stay in their own house, now becomes classified as a UK resident according to the SRT how does HMRC contact them when they have been paying their taxes to the Cyprus Government ?

And will HMRC want money !

We have had loads of correspondence from HSBC and until now the significance of the 46 days has not once been explained to us so thank you and pleased to find this thread.
We have been here 10 years and always enjoyed Gross interest in Uk as being confirmed "Not Ordinarily Resident" since leaving in 2005. On opening a new account last year all the questions started and our as yet unresolved problem is PROVING where we live as all correspondence goes to our PO Box (The site even after 7 years is not recognised by the post office for deliveries).

Have you any experience of this situation or guidance on how to resolve it with our Bank.When last in UK we took loads of utility bills etc to hopefully prove we did not live in a PO Box!

As a follow up to this having spoken to the UK Bank yesterday we had a pone call today asking if we wanted to rent out our house here or was it our permanent residence! Coincidence or what?

Bob, some banks/ investment firms will accept a 'home visitation letter' from a regulated IFA. You can check with them if they will accept this & I'm happy to pop in for a cup of tea next time I'm near you!
(If they want to know if the company is FCA registered you can tell them that our FCA reference number is 521324)
