Hi Guys

This is not for me personally , but would like to know to settle a minor dispute .

There are two parties going to court , but one fails to turn up on the prescribed date and time , maybe two or three times .

Will the court proceed with the case and issue a ruling ( either way ) , or will they again delay the hearing and again issue the summons to the other party to attend .

How do you see it , as in this instance I feel it is essential both parties are in the court ,( sorry cannot be more specific ) , so I feel the judge will again delay the case .

Seems also the only winners are the lawyers regardless .

What does their lawyer say?
I would have thought he/she would have asked the Judge to proceed "in absentia".
The lawyers ALWAYS win though!

I would have thought a genuine reason, like illness would be an acceptable reason. Failing that, if the person has not provided a genuine reason for non attendance, then a ruling in absentia would seem right & proper.

Except, of course, if the absentee is a friend/relative of the judge
