The defined proportions under Cyprus Inheritance rules?

Postby MacOCD » 12 May 2016 09:20

Ahead of deciding whether to stick with the new Cyprus inheritance heirship rules or add a codicil I'd like to know precisely what the proportions are under Cyprus law, it may well fit with my wishes anyway.

I'm finding lots of discussion that there are defined proportions, but can't find these listed anywhere. Can anyone provide a link to the actual rules? Hopefully in English :)

In our case it's:
No Spouse (deceased)
2 Adult Children
2 Grand Children

I have some other wishes for nephews, brothers & sisters but I need to know what proportion will be forced.

Thanks,

Mark.

I see on the general discussion page you have decided to go to a decent lawyer..good idea imo.
Links which may be worth looking at:

http://www.zambartaslawoffices.com/default.aspx?articleID=2372

from which: "The most common scenario is for the deceased to leave behind a spouse and children. In such a case, only ¼ of the estate can pass by Will. Under the Succession Laws, the rest will pass in equal shares to the spouse and children, this includes the matrimonial home. "

More comprehensive but more complex here:
http://uk.practicallaw.com/4-500-7179?source=relatedcontent

section 24?

Thank you, it's the closest I've seen yet to a complete detailed description, section 24 does provide about enough information for me to be able to ask the right questions of the lawyers next week.

The main point of clarification I'll be seeking would be if grandchildren are forced heirs if the parent from whom they are descended still survives?

I appreciate the help :)

This may also be of use..it's possibly easier to read than the practical law one I linked earlier:
