Land dispute

Hi

Since I've been back in the UK - about 6 weeks now - we have been informed that the people in the house next door which is at the back of our house and above us have hired someone (the guy opposite) to come onto our land at the back of house, clear it and level it (it was only weeds, so thank you very much) and build a stone wall out from their retaining wall onto (what we believe) is our land and fill it with what I can only assume was our soil.

We first heard about this a couple of weeks ago and friends got the Muhktar involved and we had an apology from the guy opposite for coming onto our land without permission and we understood that nothing further would happen until we get back on the 14th December.

Not so, as I've now been sent pictures of the completed wall. Apparently the people next door are saying that 2 metres of land away from their retaining wall for the whole length of it is theirs and not ours. It's funny that when I was talking to them earlier in the year we were talking about what we were going to do with the land and I said we would be using it as a vegetable plot when we were there full time. She even suggested I could plant some olive trees onto where she is now claiming is hers - which could have just been a cunning plan!

Anyway, we don't believe after looking at the land registry plans that it is hers, but with not understanding the scales of the drawing was looking to hire a topographer to determine who owns what and wondered if anyone had used one that they could recommend please?

What we do if I'm proved right, or in any event what we do about all the topsoil goodness knows, but I'm pretty upset about it all.

Nothing as serious as your issues, but we had a boundary enquiry on our complex in Tala and asked a solicitor who put us on to Andreas Papavasiliou who is a civil engineer.

I will PM you his details ...

You can of course get the Land Registry to come and put in Boundary pegs. There is a medium cost and of course you have to wait our turn..

Thanks both for the information. That's the other thing that worries me, we are waiting for Land Registry to come out to check before putting the house on the deeds and wondered if this wall would jeopardise that as it's not on the original plans?

Maybe ask this question on Nigel's section, he is CL expert on property. Jim

The one good thing about this is The Land Registry will know. Cyprus is one of about 6 countries in the world that has an exact map of who owns what with respective boundaries......all thanks to a young Lord Kitchener!
