Vehicle ownership

My wife and I have our own cars.on the registration log book we are registered as joint owners of both.If one of us dies does the other become sole owner automatically .We have been advised that the ownership still has to go to probate as the deceased partner is exactly that ,just a partner in ownership? Thank you for any advice.

We have gone to the trouble of getting our car in joint ownership , but after reading Kop end reds posting I now have doubts if it was worth doing ? :shock:

I think if a car is in joint ownership and one person dies the car is still available for the other. Whereas if in a single name and that person dies the car is put in a bonded warehouse until probate is sorted. Think that's correct, no doubt somebody will say if it is not!

When a friend's wife died a few years ago, his solicitor simply told him that he mustn't drive her car (which was only in her name) until after probate.

And probate can take a long time in Cyprus to sort out. At least when vehicles are in joint names the can be driven by the surviving partner.

My first wife's car was held in probate for over a year and I had to pay storage fees for it.

What is this about? Do you need to be the owner of a car in order to be allowed to drive it?

The family car may be registered to the man in the family. If he dies it becomes part of his estate to be shared out when probate has been granted.
This process can take a year or more and you would not officially be allowed to drive it around.

If you each sign a vehicle transfer form, & one should fall ill, transfer into the other persons name.

I still don't get it. Does that mean you need some sort of registration/certificate in order to be allowed to drive a car which is not your own? Couldn't I e. g. borrow my car to anyone (provided they have a driver license)?

Jeba, the short answer is NO you cannot loan your car to anyone with a license.

It will depend on what YOUR insurance company allow. Ours specifies only drivers over 25 with a clean license.
